License to use Yandex Search Engine

1. General Provisions

1.1. YANDEX LLC (the “Yandex”) offers an Internet user (the “User”) to use the Yandex Search Engine for searching information posted on the Internet according to their interest. The service is available at: https://www.yandex.com (the “Service”).

1.2. These Terms constitute an addendum to the Yandex Services User Agreement regarding the procedure for using the Service. In all other respects not provided for herein, the relationship between Yandex and the User in connection with the use of the Service shall be governed by the Yandex Services User Agreement (https://yandex.com/legal/rules), as well as the Privacy Policy (https://yandex.com/legal/confidential).

1.3. By starting to use the Service/certain functions thereof, the User shall be deemed to have accepted these Terms and terms of all of the above documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.4. Yandex may amend these Terms without any special notice; revised Terms shall come into effect once posted online at the URL specified in this paragraph, unless otherwise stipulated in revised Terms. The current version of the Terms shall always be available at: https://yandex.com/legal/termsofuse.

1.5. If Yandex has made any amendments to these Terms according to the procedure specified in Clause 1.4 hereof, and the User disagrees with these amendments, the User shall cease using the Service.

1.6. All currently available functions of the Service along with any developments and/or newly added functions shall be subject to these Terms. Some functions of the Service, decsribed in these Terms, may not be accessible to the User depending on the region in which the Service is provided.

1.7. In compliance with Regulation (EU) 2022/2065 (DSA), Yandex discloses the average monthly active users of the Service in the European Union, as defined in Article 24(2) of the DSA.

For the six-month period ending December 2024, 3.5 million average monthly active users of the Service in the EU.

2. Use of the Service. Certain Functions of the Service

2.1. The Service shall be provided to the User free of charge and shall be intended exclusively for personal, non-commercial use, except as provided for in this License, the documents provided for in Clause 1.2. hereof, or the Terms of Use of Yandex services.

2.2. If the Service is used for commercial purposes to provide search and/or Internet navigation services, the User shall notify their client and provide a link to the Yandex Service (https://www.yandex.com). The User may place a search form on their personal or corporate website for transmitting search queries to Yandex with mandatory compliance with the Yandex.Search service terms of use for the website (https://yandex.ru/legal/site_termsofuse).

2.4. Yandex reserves the right not to process queries from any Users, websites or programs that violate the terms hereof.

2.5. Terms of Use of the Function of Warning about potentially dangerous websites.

2.5.1. The function of warning the User about websites containing pages which may be potentially dangerous to visit for a User (hereinafter referred to as Potentially Dangerous Websites), for example, pages containing malicious code (hereinafter referred to as the Function), shall be provided by Yandex on “as is” basis. Potentially Dangerous Websites may also be downgraded at ranking or excluded from the Service database. Information about the potential danger of a particular website, as well as about the alleged degree of such danger and its nature (hereinafter referred to as the Information) shall be provided by Yandex partners or determined by Yandex using its own methods. Yandex shall not provide explanations regarding the grounds for classifying the website as potentially dangerous. Yandex shall not guarantee that the Function meets the User's goals and expectations, uninterrupted and error-free operation of the Function, and neither does it guarantee the accuracy of the Information (in particular, it does not guarantee that websites that are not marked as potentially dangerous do not really contain any malicious code, and vice versa). The User shall independently assess the risks and bear full responsibility for its actions related to the use of the Information. Yandex will not be liable and will not compensate for any damage, direct or indirect, caused to the website owner, the User or third parties as a result of the use or inability to use the Function, as well as a result of the use or inability to use the Information, including, but not limited to losses caused by inaccuracy of the Information provided.

2.5.2. All comments and/or complaints related to the Function operation shall be sent via the feedback form: https://yandex.com/support/search/troubleshooting/feedback.html.

2.5.3. Yandex may, at its sole discretion, terminate or suspend the provision of Information without giving reasons.

2.6. Some links to websites displayed in search results may be accompanied by special tags that provide additional information about the website and/or its characteristics. Special tags may be automatically assigned to the website based on automatic processing of User activity data, or they may contain explanations about the source of such information. Special tags shall be placed and provided to Users on an “as is” basis. Yandex will not be liable for the accuracy of the special tag placement and the reliability of additional information about the website, as well as for decisions made by Users based on such tags. 3. Websites Indexing

3.1. Yandex shall index website pages created by third parties. Yandex shall not be liable for the quality and content of such pages. Indexation shall be performed automatically using certain algorithms that do not imply any prior or subsequent evaluation of website content (moderation) regarding its compliance thereof with legal, ethical or moral requirements, as well as any censorship. Yandex is not liable for the availability of websites, or the absence of content or the quality of any offers for services, products, etc. available to the User through third-party websites indexed by Yandex, or for any losses incurred by the User from utilizing such offers.

3.2. Changes on the website pages shall be tracked by the Yandex robot in automatic mode (reindexing shall also be performed) in order to update the search results. Any information and materials posted on the pages of third-party websites may be changed at any time by the particular page owner. Yandex shall not track such changes for each of the websites and shall be not responsible for the same.

3.3. Yandex does not guarantee to the User that the response to their search query will be exhaustive and that the User will receive all the information available on the Internet on the topic of interest, or for the absolute accuracy/relevance of links to the pages of websites presented in the search results of the Service for a specific User query.

3.4. The result ordering, as part of the indexing and search process, shall be fully automatic in accordance with the established relevance criteria, which may be changed to improve the quality of the search at the discretion of Yandex. Yandex gives to the relevance the meaning of the best match of search results for a specific query to the interests of Users looking for information, which may generally not coincide with the interests of website owners or individual Users. The search results page may contain advertisements accompanied by special marks and /or external design that allow you to distinguish the ads from the search results displayed on the page.

3.5. Yandex will not manipulate the website positions in the search results of the Service for any User queries (keywords), it never sells such positions to anyone and does not guarantee the immutability of the position of a particular website in the search results for a specific User query.

3.6. Search spam is an attempt to deceive the Service's search engine and manipulate its results in order to change the particular website position in search results. Websites using “search spam” may be downgraded during ranking or excluded from the Service database due to the impossibility of their correct ranking.

3.7. Yandex will not comment on the exclusion of websites from the Service database and/or the change of their position, will not notify of such actions, and does not give any guarantees or set deadlines for their re-inclusion in the Service database/change of their position.

3.8. Yandex also may not provide an exhaustive list of search spam methods that may cause the website exclusion from the Service database and/or a change in its position. 4. Information Confidentiality and Privacy

4.1. The relationship between the User and Yandex with respect to all information that Yandex may receive about the User while using the Service shall be governed by the Privacy Policy (https://yandex.com/legal/confidential).

4.2. Yandex will index pages of websites that are publicly available on the Internet, i.e. those pages that are accessible when clicking on a link, without entering a username and password, and indexing of which is not prohibited in robots.txt the corresponding website (detailed information is available at: https://yandex.ru/support/webmaster/controlling-robot/robots-txt.xml). No claims regarding the accessible website pages being indexed via the Service shall be accepted.

5. Interactive Search Elements

5.1. Yandex may place interactive search elements on a page containing search results in one of the forms described below or in several forms at the same time:

5.1.1. Deleted.

5.1.2. Information blocks are improved responses with data Yandex offers the User to acquaint themselves with, regardless of review of the result content.

The information blocks of the improved responses are intended to present information in the most user-friendly format.

These information blocks may be presented as a digest (a quick response to a User's search query in the line for a search query), or as a block anywhere on the page vacant from search results, or otherwise, taking into account the rules established by this paragraph.

Such blocks on the page with the result shall be located with the separation of such blocks from the search results: using the differences in the design of such a block and the output and / or by means of the location of the block outside the output, or by other means.

The improved responses shall be created based on the Yandex search database and placed by Yandex automatically using information obtained from open sources, third-party sites provided by Yandex Partners in accordance with the Partner Integration Policy with the Yandex search engine (https://yandex.ru/legal/search_partner_integration_policy), as well as received from Yandex services.

The information provided in the improved responses shall be for reference only. The Service functionality shall not be intended to be used for the purpose of establishing legally significant facts, promoting in search results, expressing an objective rating of the information provided and other purposes. Any information contained in the improved responses shall require confirmation on the page of the source of such information.

Yandex shall not be responsible for the improved responses content, for the availability of the functions performed by them and /or for the accuracy, reliability, relevance, compliance with legislation and completeness of the information provided in them, as well as for the consequences of their use by the User.

The User may complain about the information in the information block of the search results by filling out the appropriate form on the page: https://yandex.com/support/abuse/troubleshooting/search/search-appearance.html, or quickly report a problem through the tools available directly in the information block.

5.2. Interactive search elements will not affect the operation of automated search algorithms functioning without human involvement and may not be qualified as a tool for allocating any priorities and advantages to third-party websites when ranking search results.
