Terms of Use for Yandex.Maps Service

This document is a translation of Terms of Use for Yandex.Maps Service in English. In case of conflict between the Russian version of Terms of Use for Yandex.Maps Service and this translation - only the Russian version of Terms of Use for Yandex.Maps Service is legally binding. 1. General Provisions

1.1. YANDEX, LLC (hereinafter Yandex) offers the Internet user (hereinafter – the User) to use Yandex.Maps service available at http://maps.yandex.com/ (hereinafter – the “Service”).

1.2. These Terms constitute an addendum to the User Agreement for Yandex Services relating to the procedure for using the Service. In all respects not covered herein, relations between Yandex and the User in connection with the Service use shall be regulated by the User Agreement for Yandex Services (https://yandex.com/legal/rules) and the License to use Yandex Search Engine (https://yandex.com/legal/termsofuse), and the Privacy Policy (https://yandex.com/legal/confidential).

1.3. Once the User starts using the Service/its individual functions, it shall be deemed that the User accepted these Terms as well as the terms and conditions of all the above-mentioned documents, to the full extent, without any exceptions or reservations. If the User disagrees with any of the provisions in the said documents, the User may not use the Service.

1.4. These Terms may be amended by Yandex without any special notification; a revised version of the Terms shall come into effect from the moment of its placement in the Internet on the Web site specified in this paragraph, unless otherwise provided for in the revised version of the Terms. The effective version of the Terms shall be available at all times on the page at: https://yandex.com/legal/maps_termsofuse .

1.5. If Yandex has made any amendments to these Terms according to the procedure specified in Clause 1.4 hereof, and the User disagrees with these amendments, the User shall stop using the Service.

1.6. The Service enables the User to gain free access to updated mapping and other reference information. All currently existing functions of the Service as well as their development and/or addition of new ones shall be deemed the subject matter hereof.

1.7. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message.

2. Use of the Service. Individual Functions of the Service

2.1. The Service uses objects of intellectual property rights to which are held by relative copyright holders, and information provided by its holders. The full list of the copyright holders and the information holders is given in Clause 3 hereof.

2.2. Any information used in the Service, including cartographic materials and traffic (traffic congestion) data (hereinafter referred to as the Data), is only meant for personal non-commercial use. In this respect, it is prohibited to copy the data, reproduce, process, distribute them, make them available to the public (publish) in the Internet, use them in any way in the media and/or for commercial purposes without the rightholder’s prior written permission, except as expressly stipulated by the functionality of the Service, these Terms, terms of use of other Yandex services or documents specified in cl. 1.2 of these Terms.

2.3. The Service functionally enables the User to add, at the User’s choice and its own discretion, user information, including signs, marks, inscriptions, messages, etc. (hereinafter – the “User Objects”), on the maps. Application of the User Objects does not modify the source Data, and it shall be acceptable solely for the User’s convenience in using the Service. The User shall be entitled to create, store and place links to the User Objects for free access in the Internet. The links to the User Objects may be also distributed by other users of the Service.

2.4. The Service provides the User with the functionality to receive map code as of the time of receipt to insert it in its website, blog or mobile application. This function is available to the User only within websites or mobile applications that can be used freely and readily by the general public. The function cannot be used for projects requiring payments or otherwise limiting access thereto for third parties. The need to register shall not be deemed limiting access under this clause.

2.5. The User shall fully bear all risks and responsibility for choosing the location of the User Objects, compliance with the law, contents, completeness, correctness and reliability of the description of added User Objects at its own discretion. Yandex shall bear no responsibility for designation and description of any User Object, shall not confirm or argue against compliance with the law, correctness and reliability of the description of any User Object. Yandex reserves the right, without notice and at its own discretion, to delete any User Object or a set of User Objects, if the information in its description conflicts with the law of the Russian Federation, contains abusive language, and also in other cases when the designation and/or the description of the User Objects and/or distribution of the link to the User Objects violates these Terms, the terms of using other Yandex services or provisions of the documents specified in Clause 1.2 hereof, as well as for the purpose of protection of interests of Yandex, service users, and/or other third parties. Yandex does not guarantee integrity of data about the User Objects to any extent and/or during any time, including in the event of Data modification due to Yandex.Maps Service development or change.

2.5.1. Any User Objects can be used by Yandex in other Yandex services and applications as well as in promotional or marketing materials placed at Yandex resources in the Internet to draw other users’ attention to the User Objects, the Service in general or other Yandex applications and services, third-party goods, works and services, both indicating and without indicating the User Object author (the name (pseudonym) of the User which it entered upon registration or in its data setup in the relevant section of the Service will be specified as the author’s name), with no need to receive the User’s special permission and with no royalty fee paid, with the right of Yandex to entitle third parties to use such User Objects in the said promotional or marketing materials. In this respect, the User acknowledges and agrees that Yandex has no obligation to review such User Objects, and they can be automatically used by software in the said manner and for the said purposes. If the User may not entitle Yandex to use any User Object this way, it shall refrain from adding such a User Object.

2.6. Mapped information on the cost of goods and services offered at the location of the object indicated on the map is provided by partners of the Service. The information is for reference only. Yandex does not guarantee that the quoted prices are accurate, up-to-date and/or compliant with real prices set when the User sought goods/services at the location of the object, and shall not be held liable for the quality of acquired goods/services.

2.7. The Service functionally enables the User to automatically plan a route on the maps showing an optional route from the starting point to the destination indicated by the User (hereinafter – the “Route”). The routing does not modify the source Data, and it shall be acceptable solely for the User’s convenience in using the Service.

2.8. The User shall fully bear all risks and responsibility for choosing the Route and following the chosen Route at its own discretion. Yandex does not guarantee accuracy, optimality, relevance of the Routes and/or compliance of the Routes with the traffic rules, and it shall not bear any responsibility for the User’s choice of and following the Route.

2.9. Yandex reserves the right, at its own discretion, to restrict the User’s access to the Service (or to certain functions of the Service if this is technologically possible) under the User’s account, or to fully block the User’s account in case of repeated violation of these Terms, or to apply other measures to the User in order to ensure compliance with the requirements of the law or observance of the rights and legitimate interests of third parties.

2.10. When using the Service, the User can report of inaccurate Data placed in the Service (incorrect name, map positioning, irrelevant Data, objects that need to be removed) giving relevant details in a special contact form of the Service. The content of a message sent by the User through this function is publicly available and posted in Yandex Map Editor (https://n.maps.yandex.ru) for registered users of such Service to assess whether the reported information is reliable and relevant. When sending a message, the User consents to publish the message form he or she completed. The User undertakes not to specify any information qualified by laws of the Russian Federation as sensitive information, including own personal details, personal details of third parties and information prohibited for distribution.
