Terms of Use for Yandex Map Editor

This document is a translation of Terms of Use for Yandex Map Editor (Yandex.People’s Map) Service in English. In case of conflict between the Russian version of Terms of Use for Yandex Map Editor Service and this translation - only the Russian version of Terms of Use for Yandex Map Editor is legally binding. 1. General Provisions

1.1. YANDEX LLC (hereinafter referred to as Yandex) offers the Internet user (hereinafter referred to as the User) to use Yandex Map Editor available at: https://mapeditor.yandex.com (hereinafter referred to as the Service).

1.2. These Terms constitute an addition to the User Agreement for Yandex Services and describe the way to use the Service. In all respects not covered herein, relations between Yandex and the User associated with the Service shall be governed by the Terms of Use for Yandex.Maps Service (https://yandex.com/legal/maps_termsofuse), the User Agreement for Yandex Services (https://yandex.com/legal/rules), the License to Use Yandex Search Engine (https://yandex.com/legal/termsofuse) and the Privacy Policy (https://yandex.com/legal/confidential) (hereinafter referred to as Regulatory Documents).

1.3. Once the User starts using the Service / its certain functions, it shall be deemed that the User accepted these Terms as well as the terms and conditions of all above-mentioned documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.4. Yandex can amend these Terms without any special notification. An updated version of the Terms shall become effective once posted online at the URL specified in this paragraph, unless otherwise stipulated by the updated version of the Terms. The most recent Terms can always be found at: https://yandex.com/legal/pmap_termsofuse.

1.5. If Yandex somehow amended these Terms as prescribed by cl. 1.4 hereof and the User disagrees with the amendments, the User shall cease using the Service.

1.6. The Service enables the User to create and/or edit content free of charge – schematic markings and/or descriptions of geographical features (buildings, constructions, houses, roads, etc.) (hereinafter referred to as the Data), to view the Data placed by other Users and updates with additional information and comments thereto and to use the Service in other ways compatible with these Terms and provisions of the documents specified in cl. 1.2 hereof. All current functions of the Service and any developments thereof and/or new functions added constitute the subject matter of these Terms.

2. Use of the Service. Individual Functions of the Service

2.1. Service guidelines can be found at: https://yandex.com/support/mapeditor/rules_2.html.

2.2. When the Data are placed in the Service, it will indicate the name (pseudonym) of the User that placed the Data, which was entered when signing up or in personal data settings in the relevant section of the Service.

2.3. A diagram gleaned from users’ Data is not a cartographic piece as defined in defined in geodesy and cartography laws of the Russian Federation. Yandex does not guarantee the geometrical accuracy and preserved cartographical projection of the Data.

2.4. The Data are stored in the Service database and are available on the Service website or in other Services of Yandex. Yandex does not guarantee the safekeeping of the Data in any scope and/or during any period of time, including where the Data change as the Service develops.

2.5. Yandex may, with no notice provided to the User and with no reason given, reject to place any Data or delete, at any time, the Data from the Service website, edit them or replace by the Data posted by other users. For instance, the Data can be deleted for the following reasons:

2.5.1. placement of the Data violating provisions of Regulatory Documents;

2.5.2. placement of advertising as part of the Data;

2.5.3. placement of individuals’ advertisements as part of the Data.

2.6. The User agrees that the Data it placed in the Service will be viewable and editable for all other Yandex users. It is not permitted to use the Data in other ways except as enabled in the Service. Yandex shall not be held liable for any third-party use (both legal and illegal) of the Data placed in the Service, including reproduction and publication both in the Service and in other ways possible.

2.7. Using the Service, the User agrees to receive promotional messages pursuant to P. 1, Art. 18 of the Federal Law “On Advertising”. The User may stop receiving the promotional messages through the relevant function of the Service.

2.8. The User transfers to Yandex the rights to use the Data in full and by any means. The Data the User placed in the Service can be used in other Yandex services and resources and, with the consent of Yandex, in third-party resources and in promotional and marketing materials with and without the User’s name (anonymously) with no need to secure a special permit of the User and with no reward paid. If the User may not grant to Yandex the right to use any Data this way, the User may not place the Data in the Service. The rights to the database constituting a collection of the Data created through the Service are vested in Yandex.

2.9. The User shall be held solely liable for its activities such as creating and placing the Data through the Service, inter alia, for compliance of the posted Data with legal requirements and respect for third-party rights and legitimate interests as well as for the choice of location, content, completeness, correctness and accuracy of the Data.

2.10. Yandex does not guarantee that the Data posted in the Service comply with goals and expectations of the User and that the User profile and the Data the User posted in the Service are kept safe.

2.11. The Users shall use the Service or the Data placed at own risk. Yandex shall not be held liable for the Data the User posted, does not confirm or deny their accuracy and reliability. Yandex shall not be held liable and will not pay for any damage, direct or indirect, inflicted on the User or third parties through the use of the Data posted in the Service.

2.12. Yandex reserves the right to restrict, at own discretion, access to the Service (or to certain functions of the Service, if technically feasible) for the User through its account or to fully block the User’s account, if repeated violations of these Terms occur, or to take other measures to comply with legal requirements or third-party rights and legitimate interests.
