Terms of Use for Yandex Map Editor

1. General Provisions

This document is a translation of Terms of Use for Yandex Map Editor (Yandex.People’s Map) Service in English. In case of conflict between the Russian version of Terms of Use for Yandex Map Editor Service and this translation - only the Russian version of Terms of Use for Yandex Map Editor is legally binding. 1.1. YANDEX LLC (hereinafter referred to as Yandex) offers the Internet user (hereinafter referred to as the User) to use Yandex Map Editor available at: https://mapeditor.yandex.com (hereinafter referred to as the Service).

1.2. The Terms of Use for Yandex Map Editor (hereinafter referred to as the Terms) constitute an addition to the User Agreement for Yandex Services and describe the use the Service. In all that is not provided for in the Terms, the relations between Yandex and the User associated with the Service shall be governed by the Terms of Use for Yandex.Maps Service (https://yandex.com/legal/maps_termsofuse), the User Agreement for Yandex Services (https://yandex.com/legal/rules), tthe License to Use Yandex Search Engine (https://yandex.com/legal/termsofuse) and the Privacy Policy (https://yandex.com/legal/confidential) (hereinafter referred to as Regulatory Documents).

1.3. Once the User starts using the Service / its certain functions, it shall be deemed that the User accepted the Terms as well as the terms and conditions of all above-mentioned documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.4. Yandex can amend the Terms without any special notification. An updated version of the Terms shall become effective once posted online at the URL specified in this paragraph, unless otherwise stipulated by the updated version of the Terms. The most recent Terms can be found at: https://yandex.com/legal/pmap_termsofuse.

1.5. In case Yandex somehow amended these Terms as prescribed by cl. 1.4 hereof and the User disagrees with the amendments, the User shall cease using the Service.

1.6. By using the Service, the User consents to receive informational messages. The User may unsubscribe from messages by using relevant functions of the Service or following the instructions specified in the received message.

2. Use of the Service. Individual Functions of the Service

2.1. The Service enables the User to create and/or edit content free of charge – schematic markings and/or descriptions of geographical features (buildings, constructions, houses, roads, etc.) (hereinafter referred to as the Data), to view the Data placed by other Users and updates with additional information and comments thereto and to use the Service in other ways compatible with the Terms and provisions of the documents specified in cl. 1.2 hereof. All current functions of the Service and any developments thereof and/or new functions added constitute the subject matter of the Terms.

2.2. The User agrees not to post data prohibited by applicable law or data not in compliance with the Service guidelines published at: https://yandex.com/support/mapeditor/rules_2.html.

2.3. The User is notified that the name (pseudonym) of the User who placed the Data will be indicated within the Service. The indicated name (pseudonym) of the User is the one that was specified during registration or in the settings of his personal data in the appropriate section of the Service.

The User shall be notified and consent to the publication and further use of the User’s image posted on the Service to Yandex, for the purposes and in the ways specified in the Terms.

2.4. The Data is stored in the Service database and available on the Service website or in other Yandex services. Yandex does not guarantee the safekeeping of the Data in any scope and/or during any period of time, including is the Data changes due to the Service development.

2.5. Yandex may, with no notice provided to the User and with no reason given, reject to place any Data or delete, at any time, the Data from the Service website, edit them or replace by the Data posted by other users. In particular, the Data may be deleted for the following reasons:

2.5.1. placement of the Data violating provisions of Regulatory Documents;

2.5.2. placement of advertising as part of the Data;

2.5.3. placement of individuals’ advertisements as part of the Data.

2.6. The User agrees that the Data he/she placed within the Service will be available to all other Yandex users for viewing and editing. The use of Data in other ways besides purposes and functions provided by the Service are not allowed. Yandex is not responsible for the use (both lawful and unlawful) by third parties of the Data hosted within the Service, including reproduction and communication to the public, carried out both within the Service and in other possible ways.

2.7. The User transfers to Yandex the rights to use the Data in full and by any means. The Data the User placed in the Service can be used in other Yandex services and applications and, with the consent of Yandex, in third-party resources and in promotional, informational and marketing materials with or without the User’s name (anonymously) with no need to secure a special permit of the User and with no reward paid. If the User is not in capacity to grant the right to use any Data to Yandex, the User may not place the Data in the Service. The rights to the database constituting a collection of the Data created through the Service are vested in Yandex.

2.8. The User shall be solely liable for its activities such as creating and placing the Data through the Service, inter alia, for compliance of the posted Data with legal requirements and respect for third-party rights and legitimate interests as well as for the choice of location, content, completeness, correctness and accuracy of the Data.

The User acknowledges and agrees that Yandex is not obliged to review such Data, and its use by specified methods for the specified purposes can be carried out automatically by means of software.

2.9. Yandex does not guarantee that the Data posted within the Service meets expectations of the User or access to the User’s profile and the Data the User posted in the Service.

2.10. The Users shall use the Service or the Data placed at own risk. Yandex shall not be held liable for the Data the User posted, it does not confirm or deny the accuracy and reliability of the Data. Yandex shall not be held liable and shall not pay for any damage, direct or indirect, inflicted on the User or third parties through the use of the Data posted within the Service.

2.11. Yandex, at its own discretion, reserves the right to restrict the User’s access to the Service (or to certain functions of the Service, if technically feasible) through his/her account or to fully block the User’s account in case of repeated violations of the Terms, or to take other measures to comply with legal requirements or third-party rights and legitimate interests.

2.12. Any information used in the Service is intended solely for personal, non-commercial use. Any copying of the Data, its reproduction, processing, distribution, making available to the public (publication) on the Internet, any use in the media and / or for commercial purposes without the prior written permission of the copyright holder is prohibited, except for cases expressly provided by the functionally of the service, the Terms, or the terms of use of other Yandex services, or documents specified in clause 1.2. of these Terms.
